Rabbi Akiva Eiger refutes this by demonstrating from the Mishnah's parallel case of a garden (v'chen b'ginah) that ratzu must teach a more fundamental principle — that hezek re'iyah is not actionable damage — since otherwise the garden case, where no kinyan is involved, could not share the same rule of building per local custom.
