Whether Divorced Couple's Cohabitation Requires a Second Get

From: Rabbi Moshe Sofer

To: Rabbi Meir

Description

A divorced couple resumed cohabiting believing the get was invalid, with no formal kiddushin ceremony, and the woman now wishes to remarry. The Chasam Sofer rules leniently that she likely does not require a second get, since neither party intended kiddushin and the cohabitation was therefore beilas znus, and further citing the Terumas HaDeshen that kiddushin through biah is not practiced in later generations. He nonetheless defers the final practical ruling to the local rabbi.
