Description

A community sold premium synagogue seats before construction, then tried to reassign paired women's section seats to a later buyer, arguing the original sales were invalid as a davar shelo bala'olam and that the new buyer had bar metzra rights. The Chasam Sofer rules the original sales are fully valid since the land already existed, and the bar metzra claim fails because cross-section seat pairing does not constitute physical adjacency.
