Validity of Meshikhah Alone to Establish Non-Jew's Partnership for Bechor Exemption

From: Rabbi Moshe Sofer

To: Rabbi Yechezkel Segal

Description

A non-Jew who received a share in a cow as a gift and performed meshikhah without being granted a place in the courtyard does not acquire a valid partnership. The Chasam Sofer defends the Ramban's position and rules that chatzer — granting the non-Jew a place where the animal is located — is required, and that meshikhah alone does not suffice to exempt the animal from bechor.
