Validity of Get Written Without Formal Appointment of Scribe by Husband

Date: 28 Adar Sheini

From: Rabbi Moshe Sofer

To: Unknown recipient

Description

The Chasam Sofer defends his earlier positions against pointed objections, arguing that 'bateil' in Beraisa terminology need not indicate Torah-level invalidation, that only the husband's da'as (not formal shlichus) is required for the scribe, and that a woman's original consent at kiddushin establishes an irrevocable basis for divorce against her will via eidei chasimah alone.
