Validity of Get Delivered by an Am Ha'aretz Agent

From: Rabbi Moshe Sofer

To: Rabbi Pinchas Leib Munk

Description

The Chasam Sofer rejects the concern that ordinary Jews, suspected of ribis violations, are disqualified from serving as agents for get delivery under the Rambam's minority opinion. He argues that the presumption of kashrus applies to ordinary Jews, that common financial dealings likely did not constitute Torah-level ribis, and that in any case the modern practice of including a cherem and oath in the harsha'ah eliminates even the Rambam's concern entirely, rendering the get valid.
