Validity of Conditional Get Fulfilled After Husband's Death

From: Rabbi Akiva Eiger

To: Unknown recipient

Description

The Chasam Sofer rules that a woman whose husband died after giving her a conditional get may fulfill the condition (relocating to her father's city) posthumously, validating the get and exempting her from chalitzah. He distinguishes between conditions imposed for the husband's financial benefit and those meant to cause the wife distress, arguing that distress-based conditions are presumed forgiven at death, and demonstrates that this framework vindicates the Bahag against the objections of the Ran and Maggid Mishneh.
