Validity of Conditional Get After Husband's Death and Chalitzah Exemption

From: Rabbi Moshe Sofer

To: Unknown recipient

Description

A husband issued a conditional get requiring his wife to relocate within one year, but died four months later before the condition was fulfilled. The Chasam Sofer rules that the condition is presumed forgiven upon the husband's death under the Ra'avad's principle of mechilah, rendering the get valid and exempting the wife from chalitzah, provided the condition was phrased as a one-time relocation rather than a permanent prohibition.
