Testamentary Endowment for Torah Study and Ribbis Concerns

From: Rabbi Moshe Sofer

To: Unknown recipient

Description

The deceased Meir ben Rabbi Shimon left a deathbed will directing his son Rabbi Moshe Avraham to pay fixed annual sums from 400 Gulden of capital to Torah scholars and the local Av Beis Din. The son later challenged the arrangement, arguing the stipulated payments exceed the capital's market return and that no formal iska agreement was ever made, raising a ribbis concern. This teshuva presents only the factual background; the legal ruling follows separately.
