The Chasam Sofer defends his lenient ruling that a Jew who recognizes his seal through tevi'as ayin (intimate visual recognition) need not maintain a guard over wine stored with a non-Jew, distinguishing this from the mirtas-based leniency of a standard depositor. He argues the Baraisa's stringency requiring yoshev u'meshamer applies only to mirtas-based cases, not to actual tevi'as ayin verification, and supports this with sources from Chullin and the Yerushalmi. He additionally rules that a rabbinic hechsher for a wine press should not be suspected of incompetence.
