Description

The Chasam Sofer rules that Rabbi Avraham cannot be removed from his rabbinical position, as the three-year communal custom was never intended to permit actual removal and the principle of ma'alin bakodesh v'lo moridin applies. He further rules that use of non-Jewish governmental authorities to obtain the position is absolutely forbidden, that an omer mutar does require repentance, and proposes a practical compromise of shared duties between the two rabbis.
