Permissibility of Removing Grapevines for Building Purposes and Bal Tashchis

Description

The Chasam Sofer rules that removing fruit-bearing grapevines to build on the land is permitted when building is clearly more profitable, as such removal is not considered destructive cutting. However, if the vines can be uprooted with their roots and soil intact for replanting elsewhere, one is obligated to do so rather than cut them down. Beyond the halachic prohibition, there is also an element of mortal danger associated with cutting fruit trees, which applies even more broadly than the prohibition itself.
