Miscarriage on Fortieth Day After Tevilah — Concern for Vlad Status

From: Rabbi Moshe Sofer

To: Unknown recipient

Description

A woman miscarried on the fortieth day after her tevilah, raising the question of whether the miscarried matter must be treated as a potential vlad. The Chasam Sofer rejects the lenient position of the ע"הG — which argued that prior pregnancy was impossible because a pregnant woman is mesulekes damim — by demonstrating that mesulekes damim status requires both fetal blood diversion and the physical heaviness of hukar ubarah, neither of which alone suffices before three months. He rules stringently that the miscarriage must be treated as a possible vlad, and that the woman must count seven clean days and wait until the night of the fifteenth day.
