Kesubas Bnin Dichrin: Surplus Dinar and Creditor Collection

From: Rabbi Akiva Eiger

To: Unknown recipient

Description

Rabbi Akiva Eiger resolves the apparent redundancy in the Rif's ruling on Kesubas Bnin Dichrin by applying the Rosh's principle that a creditor collects "from now onward" as a newly arising matter, showing that a creditor's post-death collection does not retroactively create the required surplus dinar at the time of death. He also offers an innovative reading of the Ran regarding a widow's inability to seize movable sale proceeds, based on the Halachos Gedolos' view that such proceeds do not retain the status of the original inherited land.
