Equal Division of Wine Brokerage Fees Under Government Decree

From: Rabbi Moshe Sofer

To: Rabbi Nosson

Description

Three Jewish wine brokers in Tokaj were subject to a county decree mandating equal division of brokerage fees regardless of which broker served a particular merchant. The Chasam Sofer ruled unequivocally in favor of Reuven, holding that the government regulation satisfies dina d'malkhusa dina and is independently valid under Torah law, obligating Shimon and Levi to pay Reuven his equal share of all past and future brokerage earnings.
