Drafting a Will to Equalize Sons' and Daughters' Inheritance

Date: Erev Monday, 6 Elul 5577

From: Rabbi Moshe Sofer

To: Rabbi Wolf Chayes

Description

The Chasam Sofer refuses to assist in drafting a will that equalizes daughters' inheritance with sons', citing the Talmudic prohibition against disinheriting sons. He nonetheless advises his student on several practical halachic pitfalls in such a document, covering issues of issur nechasei, maintenance rights of minor daughters, kinyan agav via four amos in a courtyard, the validity of chalipin with bank notes, and the requirement that a stepmother-guardian not be exempted from the guardian's oath.
