Division of Charitable Funds and Synagogue Between Two Kollelim in Tiberias

From: Rabbi Moshe Sofer

To: Rabbi Yisrael of Shklov

Description

The Chasam Sofer upholds the beis din's ruling that it need not disclose its reasoning, and that anyone who tears up the ruling is liable to niddui. He rules that Kollel Russia is entitled to one-third of collective income proportional to their share of expenses, establishes that local custom (minhag) has d'Oraisa status, permits the two kollelim to separate, and concludes that the shared synagogue is subject to din chalukkah between two communities with the option of gud o igud.
