Disposition of Spousal Gifts Upon Dissolution of Marriage

Date: Erev Shabbos, 19 Adar 5570

From: Rabbi Moshe Sofer

To: Unknown recipient

Description

The Chasam Sofer issues eight practical rulings distinguishing between clothing and adornments (subject to appraisal upon departure) and genuine gifts of land, money, or movable property (which remain the recipient's). When a husband voluntarily divorces his wife, her clothing is not appraised and she keeps it; if she caused the divorce through misconduct, her clothing is appraised. Gifts given by the wife's family to the husband are always his, except when the wife was discovered to have been forbidden to him from before the marriage, in which case all gifts revert.
