Contradicted Deathbed Will Directing Endowment Fund to Competing Communities

From: Rabbi Moshe Sofer

To: Rabbi Shmuel Shmelka Meizlish

Description

A dying man's witnesses contradicted each other about whether his endowment fund was directed to his hometown of Semeri or to Kat where he died; the Chasam Sofer rules that since the testimonies were given at different times, the earlier instruction was simply retracted, and the fund profits go to Semeri. He rules that witnesses from either community are disqualified by financial interest, and strictly forbids diverting the principal for any other communal purpose.
