Compelling Divorce for Non-Support and Wife's Rape Claim

From: Rabbi Moshe Sofer

To: Rabbi Meir

Description

The first teshuvah rules that when a husband cannot support his wife, the beis din should sell his property, use proceeds for her maintenance, and then require him to either divorce her or support her as able, endorsing a compromise of an immediate get with a payment of four hundred gold coins. The second teshuvah permits a wife who claims rape by her brother-in-law to remain with her husband, since a married woman is not forbidden absent raglayim ladavar equivalent to kinui and setirah, and her claim of rape is believed without requiring a migo.
