Description

The Chasam Sofer defends the Shach's proof from Rashi (Kesubos 85a) that a person suspected of swearing falsely (chashud) who holds a validated document retains the right to collect without an oath. He argues that Rashi avoided explaining the case as involving a kesubah not because of the suspected woman's automatic loss, but to prevent implying the existence of a document, which would conflict with a later Talmudic discussion about kim li b'gavah undermining validated documents. He further rules that one cannot simultaneously apply two leniencies — the rabbinic origin of the kesubah and the leniency of accepting kim li b'gavah as a basis for suspicion.
