Description

Regarding appreciated dowry property, the ruling depends on whether the property was assessed at marriage: if assessed (tzon barzel), appreciation belongs to the husband's estate and the wife must compensate for any surplus; if unassessed (melog), all appreciation belongs to the wife. Creditors do displace the widow from her maintenance rights, including for oral loans and movables due to the Gaonic enactment. Community debts have no inherent legal priority over private debts; any preference derives solely from local custom, with the exception that a community ledger may function as a written document giving it priority over oral creditors.
